			<content:encoded><![CDATA[<p>Exchange-Traded Funds (ETFs) tracking emerging markets have had a remarkable run. In 2005, the South Korea (EWY) was been up 57%, Brazil (EWZ) up 56%, Mexico (EWW) up 49% and the Emerging Markets (EEM) up 34%. In the last 12 months, China (FXI) has shown some life up 26% and South Africa is up 32%.</p>
<p>The MSCI Emerging Market index is up 82% since mid-2004. In addition, lower risk countries like Singapore (EWS) have been up for four straight years and its Straits Times Index has risen by 85% since 2003.</p>
<p>I am getting a lot of call lately about what to do next. Should investors buy, hold or sell?</p>
<p>There are two arguments out there about the future of emerging markets at polar extremes from each other. BCA Research notes that despite the run up in prices over the past three years, trailing and forward PEs are only 13 and 11 respectively. Both are far from being out of line from both a fundamental and a historical basis. Brazil is a good example with a market at about 10 times earnings.</p>
<p><a rel="attachment wp-att-656" href="http://human-test.info/whats-next-for-emerging-market-etfs/emerging-markets/"><img class="alignleft size-full wp-image-656" src="http://human-test.info/wp-content/uploads/2009/12/emerging-markets.gif" alt="emerging-markets" width="450" height="450" /></a>Morgan Stanley took a different view in a research report published last week. It points to the shrinking of the sovereign risk premium for emerging markets as a sign of potential weakness. In other words, the degree of higher interest rates demanded from the market to offset the higher risk of emerging markets has shrunk sharply. In 2004 it was 3.5% and now it is about 0.50%. There can be little doubt that this shrinkage has fueled at least part of the rise in emerging markets.</p>
<p>The truth probably lies in the middle of these extremes. The world is filling in and emerging markets will very likely outperform more mature markets but don’t expect a straight line up. Near term there will be some pullbacks in specific countries depending on circumstances.</p>
<p>Be alert, get some good intelligence, and put in place some measures to control risk. Here are a few ideas.</p>
<p>First, follow our portfolio approach whereby we weigh each <a href="http://human-test.info/tag/etf/" class="st_tag internal_tag" rel="tag" title="Posts tagged with ETF">ETF</a> in a portfolio to prevent getting carried away with too large a position in an emerging market <a href="http://human-test.info/tag/etf/" class="st_tag internal_tag" rel="tag" title="Posts tagged with ETF">ETF</a>. It is a bit like dining out, you may like Thai food once in a while but do you want it every night?</p>
<p>Second, keep emerging market ETFs out of your core portfolio which should have the goal of preserving capital.</p>
<p>Third, use our trailing stop loss strategy that kicks out an <a href="http://human-test.info/tag/etf/" class="st_tag internal_tag" rel="tag" title="Posts tagged with ETF">ETF</a> down 10% or so from its high.</p>
<p>Fourth, use put options to mitigate risk. When you buy the China <a href="http://human-test.info/tag/etf/" class="st_tag internal_tag" rel="tag" title="Posts tagged with ETF">ETF</a> (FXI), consider buying a put option on this <a href="http://human-test.info/tag/etf/" class="st_tag internal_tag" rel="tag" title="Posts tagged with ETF">ETF</a> out 18 months at the same time.</p>
<p>Fifth, if you have an emerging market <a href="http://human-test.info/tag/etf/" class="st_tag internal_tag" rel="tag" title="Posts tagged with ETF">ETF</a> that has had a great run, why not take some money off the table? As old Joe Kennedy aptly put it: “only a fool holds out for top dollar”.</p>
<p>My view is that for the most part, emerging market countries are in far better shape today than in the 1990s and valuations are not way ahead of themselves. Also some of the lower risk countries like Singapore are appealing. In the early part of 1997 before prices crashes, the Singapore Straits index was at 24 times earnings. Now it is 15 and the broader market is at 12 times earning.</p>
<p>Keep in mind that 200 years ago India and China made up 50% of world GDP. We have a long way to go with this story but you need a smart strategy able to weather some turbulence now and then.</p>

<p>It feels great doesn’t it? And, be honest, rather flattering too. And because of that you probably have more rapport with them.</p>
<p>Now let’s turn that around and say it’s you who always manages to remember people and their names. Do you think they just might be more interested in doing business with you? Or recommending you to their business colleagues who are looking for what you offer?</p>
<p>Here’s how to make remembering people easier…</p>
<p>* When you are introduced to someone make sure you <strong>hear their name clearly</strong>.</p>
<p>* <strong>Repeat</strong> the name and ask if you’ve got it right.</p>
<p>* <strong>Check the spelling</strong> with them if it is unusual… they will be flattered that you consider them important enough to take the trouble.</p>
<p>* <strong>Repeat the name twice</strong>, <span style="text-decoration: underline;">silently</span> in your mind, to give yourself a better chance of remembering it.</p>
<p>* Ask a question and <strong>listen</strong></p>
<p><strong>Listening is a Skill – Take Time to Develop It…</strong></p>
<p>The challenge we all have is to silence or ignore our own thoughts. Especially whilst other people are talking.</p>
<p>How often have you drifted off in your mind whilst someone is talking?</p>

It took me a while to stop that one, I can tell you! Especially with people who were more precise in their conversation and took their time to finish a sentence, it could be agonising for me.</p>
<p>Or if you don’t interrupt, perhaps you are busy thinking about what you are going to say <em>just as soon as they stop to take a breath</em>. Yep, been guilty of that too!</p>
<p>Guilty, that is, until I found this neat trick. Peter Thomson told me about it in the late 1990’s and it’s a real gem. He calls it <strong>Active Listening</strong>, which is a pretty good description.</p>
<p>It’s great for group meetings; presentations; 1-to-1 meetings; in fact any conversations at all.</p>
<p><strong>Here’s what you do…</strong></p>
<p>Repeat, internally, everything the other person is saying.</p>
<p>It gives you <strong>7 clear benefits</strong>:</p>
<p><strong>1) </strong> You don’t miss anything important that is being said</p>
<p><strong>2)</strong> You understand the communication better</p>
<p><strong>3)</strong> You give the impression of being <span style="text-decoration: underline;">very</span> interested in what the other person has got to say</p>
<p><strong>4)</strong> Your reply, which you won’t be in a position to make until the other person finishes speaking, appears considered and relevant because of the slight pause</p>
<p><strong>5)</strong> Your reply <span style="text-decoration: underline;">is</span> more relevant because you have completely understood the previous part of the conversation.</p>
<p><strong>6)</strong> You do not annoy the other person by interrupting them</p>
<p>and the <strong>definite bonus…</strong></p>
<p><strong>7)</strong> You can recall the conversation and important details more clearly, when you need to, at a later date.</p>
<p>By the way, it is a good idea to practise this technique in private or with a group of friends or business colleagues before ‘going live’. The other person will find it a bit disconcerting if you stare at them with a glazed look in your eyes. And they certainly will not be flattered if you move your lips whilst repeating their words internally!</p>

			<content:encoded><![CDATA[<p>A common question I hear plaintiffs ask is &#8220;How long will it take for my Personal Injury Lawsuit to settle?&#8221; or &#8220;What the average time a personal injury lawsuit takes?&#8221;</p>
<p>The only valid answer to this question is that statistically a personal injury lawsuit can average 2 to 3 years, but one must remember that no lawsuit is &#8220;average&#8221;. This means there is no expected timeframe to work with. You simply have to continue with the next step in your lawsuit and ensure that your lawyers and paralegals are working on it.</p>
<p>Another common question is &#8220;Why do personal injury lawsuits take so long?</p>
<p>The truth is that a case can be fairly &#8220;cut-and-dry&#8221;-i.e. the liability is obvious, the injuries are substantial and the insurance covers the damages-but the case can still draw out for many years. Why is that? Well, the obvious answer is money. It is in the insurance company&#8217;s best interest to extend the case as long as possible.</p>
<p>Let&#8217;s look at this logically: the insurance company is a profit-driven company. It has employees to pay. It has shareholders to make happy. It&#8217;s not easy trying to satisfy the dogs on Wall Street with greater earnings every quarter. In order to do that, it has to get creative and squeeze profits from areas it wouldn&#8217;t normally do so from.</p>
<p>One of the easiest places they&#8217;ve found to &#8220;squeeze profits&#8221; from is YOU-the plaintiff. Their policies might say that they&#8217;ll cover $100,000 in damages for the defendant, but the complex mathematical formulas on their computers already account for the fact that you are desperate and you&#8217;ll accept far less!</p>
<p>That&#8217;s right! They know that a certain percentage of plaintiffs are so poor and in such a bad financial situation (how could they not be after being out of work because of an accident) that they&#8217;ll accept 20% or even 10% of what is really due to them. This is where they can make that extra profit to satisfy shareholders!</p>
<p>One of the main questions I get is &#8220;Is it financially smart for me to get a personal injury lawsuit settlement loan?&#8221;</p>
<p>The correct answer depends on two factors:</p>
<p>1. <strong>Do you need financial assistance to survive? </strong> If your survival depends on having some cash from your settlement now, then it is probably smart to go ahead and get it. While the rates on lawsuit loans used to be incredibly high, recent competition has brought the rates down considerably. But you still have to be careful what company you deal with.</p>
<p>2. <strong>Will you get more money in the long run if you get a lawsuit settlement loan than if you accept a settlement now? </strong> Let&#8217;s look at an example. For simplicity, let&#8217;s say you are expecting $100,000 but it was going to take one year for you to get that settlement. Let&#8217;s say you have been out of work for a couple months, but you would be able to get back to work soon. The defendant&#8217;s insurance company knows you are probably desperate (as most are) and offers you a bogus $10,000. Out of desperation, you are very close to taking their offer. But then you discover a litigation finance company could give you a lawsuit settlement loan of $10,000 at 3% interest per month. This satisfies current financial demands by paying back-rent, catching up on car payments and providing food for your family until you can get back to work. By the end of the year, you get the $100,000 settlement. Of course, about $33,000 goes to the lawyer in attorney fees, and $13,448.89 goes to the litigation finance company (the $10,000 loan plus $3,448.89-3% interest compounded per month for twelve months). By taking the loan instead of the bogus settlement, you would have been able to wait a year for the full amount that was due to you and get $63,551.11 after attorney fees and interest (compare that to the $10,000 bogus offer you could have ended up accepting because you didn&#8217;t know your options!).</p>

			<content:encoded><![CDATA[<p>Although there may be many variations of Unit Trust Schemes, the structure is generally the same for all. A unit trust scheme is a non-incorporated collective investment scheme. Its purpose is to pool the savings of investors with the intention of investing and managing the savings for the investors&#8217; benefit.</p>
<p>The rules governing the operation of each Unit Trust Scheme is called a deed. The deed names the Unit Trust Management Company and the trustees. It provides details of how the unit trust scheme is to operate. The trustees are appointed to supervise the operation of the scheme. The duties of the trustees and the unit trust management company are clearly spelled out in the deed. Unit holders are also bound by the deed. Their legal rights are described in the deed, in case the terms of the deed is not followed.</p>
<p>The assets of the unit trust scheme are held in the name of the trustees. This is a safeguard separating the assets of the unit trust scheme from that of the Unit Trust Management Company, so that the unit holders are protected in case the management company go into liquidation. The assets are held by the trustees on behalf of the unit holders. Even if the trustees go into liquidation, the assets are not legally able to be paid to the trustees&#8217; creditors. Although the assets are registered in the name of the trustees, the beneficial ownership of these assets remain in the hands of the unit holders.</p>
<p>The three parties with a role in the Deed are:</p>
<p><strong>The Unit Trust Management Company</strong><br />
The unit trust management company reports to the trustee about the purchase, sale and management of investments in the unit trust scheme. They also promote and sell units of the scheme to investors (also known as &#8220;unit holders&#8221;), and buy back units from investors who wish to sell back the units. The management company keeps a record in order to calculate the selling and buying prices and to determine the amount of distribution payable to the investors.</p>
<p><strong>Trustee</strong><br />
The trustee is responsible to the unit holders to safeguard their investment, and to ensure that the money is invested according to the terms of the deed. They supervise the operations to ensure that the objectives are followed by the unit trust management company. The trustees also approve and monitor all financial transactions, they hold title documents of all the assets of the unit trust scheme, and they collect all income entitled on the investments.</p>
<p><strong>Unit Holders</strong><br />
The Unit Holders, also called investors, supply the capital to be invested by the Unit Trust Management Company on their behalf. They are responsible for paying a fee to the management company and the trustee. Unit holders hold units, the value of which is determined by a formula set out in the deed. It is based on dividing the market value of the net assets of the scheme by the number of units in circulation. Unit holders buy units in the scheme by completing the application form contained in the Unit Trust Scheme prospectus.</p>
<p><strong>Deed</strong><br />
The deed is the document that shows the rights and obligations of the Unit Trust Management Company, the rights and duties of the Trustee, and the rights of the Unit Holders. It mentions the maximum fee payable, describe the type of investment that particular scheme can make, prescribe how the value of a unit in the scheme can be determined, and determine how the price of a unit sold to unit holders and thereafter bought from them can be calculated. The deed also outline what steps should be taken should there be a need to make changes to the deed itself. Usually, this includes getting the consent of the unit holders who are asked to vote on the proposed changes. Also set out on the deed are the responsibilities of the auditor appointed by the trustee of the unit trust scheme.</p>
<p><strong>Prospectus</strong><br />
The prospectus is a document providing information on the unit trust scheme. When a Unit Trust Scheme is offered to the public, the law requires that a copy of the prospectus be made available to people interested in investing in the scheme. This allows prospective investors the opportunity to make sound investment decision. The prospectus must be registered with the Securities Commission. It must contain certain information required by law. It must be accurate and not misleading. The people involved in preparing it are accountable for its contents. If there are misrepresentations in the prospectus, legal remedies are available to investors. By completing and signing the application form from the Unit Trust Scheme prospectus, an investor becomes a unit holder of the scheme, and a party to the deed.</p>

And yet there are already all sorts of scholarships and such. The <a href="http://human-test.info/tag/american-dream/" class="st_tag internal_tag" rel="tag" title="Posts tagged with American Dream">American Dream</a> Accounts are interesting spin on the power of compounded interest and a smart idea at $500 for each new born and yet that number will need to be $1,000 due to expanding World economy and future inflation.</p>
<p>It is interesting all this pre-election maneuvering and even more interesting the economic issues during peak employment times and good economic growth. Will this political posturing help her and other democrats in the future elections? Perhaps we might all consider all this in 2006.</p>
